United States Attorney Brendan V. Johnson announced that a Timber Lake, South Dakota, man charged with Assault by Striking, Beating or Wounding was sentenced on June 7, 2012, by United States District Judge Roberto A. Lange. Thomas James Jones Winston, age 28, was sentenced to 4 months in custody and a $10 special assessment to the Victim Assistance Fund.

The conviction arose from an incident that occurred in Timber Lake on March 8, 2012, when Winston assaulted a female victim, punched her right eye, grabbed her around the neck from behind, took her to the ground, and pinned her by holding her shoulders and arms. Winston also placed his hand over her mouth so she could not scream. Winston pled guilty to the charge on April 11, 2012.

This case was investigated by the Northern Plains Safe Trails Drug Enforcement Task Force. Assistant United States Attorney Jay Miller prosecuted the case.

WInston was immediately turned over to the custody of the United States Marshal to begin serving his sentence.
