Eagle Butte Man Charged with Aggravated Sexual Abuse, Kidnapping, and Assault

U.S. Attorney Brendan V. Johnson announced that an Eagle Butte man has been indicted by a federal grand jury for Aggravated Sexual Abuse, Kidnapping, and Assault Resulting in Serious Bodily Injury.

Isiah Bryson Mesteth, age 22, was indicted by a federal grand jury on September 18, 2012. He appeared before U.S. Magistrate Judge Mark A. Moreno on September 19, 2012, and pled not guilty to the indictment. The maximum penalty on the sexual abuse and the kidnapping charges is any term of years or life imprisonment, a $250,000 fine, or both. The assault charge carries a maximum penalty of 10 years’ imprisonment, a $250,000 fine or both. The charges are merely accusations, and Mesteth is presumed innocent until and unless proven guilty.

The investigation is being conducted by Cheyenne River Sioux Tribe Law Enforcement Services. Assistant U.S. Attorney Kathryn Rich is prosecuting the case. Mesteth was remanded to the custody of the U.S. Marshal. A trial date has not yet been set.
