LaPlant Man Arraigned on Assault Charges

U.S. Attorney Brendan V. Johnson announced that a LaPlant man has been indicted by a federal grand jury on two counts of Assault with a Dangerous Weapon.

Joseph Marshall, age 33, was indicted by a federal grand jury on November 15, 2012. He appeared before U.S. Magistrate Judge Mark A. Moreno on November 21, 2012, and pled not guilty to the indictment. The maximum penalty upon conviction is 10 years' imprisonment, a $250,000 fine, or both. The charges are merely accusations, and Marshall is presumed innocent until and unless proven guilty.

The investigation is being conducted by Cheyenne River Sioux Tribe Law Enforcement Services. Assistant U.S. Attorney Mikal Hanson is prosecuting the case. Marshall was remanded to the custody of the U.S. Marshal. A trial date has not yet been set.
