
Lower Brule Man Pleads Guilty to Assaulting a Federal Officer

US Attorney Brendan V. Johnson announced that James Ewing, Jr., age 29, of Lower Brule, appeared before US Magistrate Judge Mark A. Moreno on November 29, 2012, and pled guilty to an Amended Superseding Information that charged him with Assaulting, Resisting and Impeding a Federal Officer. The maximum penalty upon conviction is 1 year in custody, a $100,000 file, or both. On April 3, 2012, at Lower Brule, Ewing assaulted, resisted, opposed, impeded, intimidated and interfered with an officer from the Bureau of Indian Affairs. He spit in the officer’s face during an arrest. The investigation was conducted by the Bureau of Indian Affairs, and Assistant US Attorney Meghan N. Dilges is prosecuting the case. Ewing was remanded to the custody of the US Marshal pending sentencing. A sentencing date has been set for February 4, 2013. |
