Sioux Falls Man Sentenced for Failure to Register as a Sex Offender and Assaulting a Federal Officer

US Attorney Brendan V. Johnson announced that a Sioux Falls man charged with Failure to Register as a Sex Offender and Assaulting a Federal Officer was sentenced on December 11, 2012, by US District Judge Roberto A. Lange. Simon Antelope, age 33, was sentenced to 30 months on each count to be served concurrently, 1 year of supervised release on the assault of a federal officer charge, 5 years of supervised release on the failure to register as a sex offender charge, and ordered to pay a $200 assessment to the Victim Assistance Fund.

Antelope was indicted for Assaulting a Federal Officer by a federal grand jury on May 8, 2012, and Failure to Register as a Sex Offender on May 31, 2012.

On April 4, 2012, Antelope knowingly failed to register and update his registration as required by the Sex Offender Registration and Notification Act following a conviction of abusive sexual contact in 2007. His whereabouts were unknown until his arrest by BIA officers in April 2012. During the booking process, Antelope shoved and then charged the officer, causing a physical struggle which resulted in Antelope striking the officer in the forehead.

The investigation was conducted by the Bureau of Indian Affairs, Crow Creek Agency and the U.S. Marshal’s Service. Assistant US Attorney Meghan N. Dilges prosecuted the case.

Antelope was immediately turned over to the custody of the US Marshal.
