United States Attorney Brendan V. Johnson announced that a Rapid City, South Dakota, man has been indicted on two counts of Felon in Possession of a Firearm, alleged to have occurred on November 30, 2011, and February 2, 2012, at Rapid City, South Dakota.
Christopher Arehart, age 38, was indicted by a federal grand jury on March 20, 2012, for two counts of Felon in Possession of a Firearm. Arehart appeared before United States Magistrate Judge Veronica L. Duffy on April 25, 2012, and pleaded not guilty to the indictment. The maximum penalty upon conviction of either count is 10 years' imprisonment and/or a $250,000 fine. The charge is merely an accusation, and Arehart is presumed innocent until and unless proven guilty.
The investigation is being conducted by the South Dakota Division of Criminal Investigation, the Rapid City Police Department, and the Bureau of Alcohol, Tobacco, Firearms, and Explosives. Special Assistant United States Attorney Laura A. Shattuck is prosecuting the case.
Arehart was remanded to the custody of the United States Marshal. A trial date has been set for July 3, 2012.
