Martin Man Guilty of Two Counts of Assault

United States Attorney Brendan V. Johnson announced that Everett Libby, age 26, of Martin, South Dakota, appeared before United States District Judge Jeffrey L. Viken on May 14, 2012, and pleaded guilty to two separate indictments that charged Libby with two counts of Assault Resulting in Serious Bodily Injury. The maximum penalty upon conviction is 10 years' imprisonment and/or a $250,000 fine on each count.

One charge relates to Libby assaulting a female at Martin, South Dakota, on July 11, 2011. Said assault resulted in the victim receiving serious bodily injuries from being strangled and dragged across broken glass. The other charge relates to Libby assaulting a male at Martin on November 11, 2011. This assault resulted in the victim having his jaw broken by being assaulted by Libby. The investigation was conducted by the Bureau of Indian Affairs, Office of Justice Services, and the Oglala Sioux Tribe Department of Public Safety.

A presentence investigation was ordered, and a sentencing date was set for August 27, 2012, on both charges. The defendant was remanded to the custody of the United States Marshal pending sentencing.
