
Kyle Man Pleads Guilty to Possessing Controlled Substances and Intoxicants in Indian Country

United States Attorney Brendan V. Johnson announced that Bernie Montileaux, age 32, of Kyle, South Dakota, appeared before United States District Judge Jeffrey L. Viken on May 23, 2012, and pleaded guilty to an indictment that charged him with Simple Possession of a Controlled Substance and Intoxicants Possession Unlawfully in Indian Country. The maximum penalty upon conviction is one year in custody and/or a $100,000 fine for each charge. The charge relates to Montileaux unlawfully possessing marijuana and vodka on the Pine Ridge Indian Reservation between May and June in 2010. The investigation was conducted by the Bureau of Indian Affairs, Office of Justice Services, and the Oglala Sioux Tribe Department of Public Safety. A presentence investigation was ordered, and a sentencing date will be set. The defendant was remanded to the custody of the United States Marshal pending sentencing. |
