United States Attorney Brendan V. Johnson announced that a Rapid City man charged with Escape was sentenced on June 5, 2012, by U.S. District Judge Jeffrey L. Viken. Wilbur Toledo Flute, age 38, was sentenced to time served and ordered to pay a $100 assessment to the victim assistance fund.

In April 2012, Flute left the Community Alternatives of the Black Hills, where he was serving part of a federal sentence, without permission and did not return. He pleaded guilty on May 11, 2012.

This case was investigated by the U.S. Marshal’s Service. Assistant U.S. Attorney Eric Kelderman prosecuted the case.

Flute was immediately turned over to the custody of the U.S. Marshal.
