
Rapid City Man Indicted for Possessing Child Pornography

United States Attorney Brendan V. Johnson announced that a Rapid City man was indicted by a federal grand jury for possessing child pornography on his computer. Gary Whiting, age 49, was indicted on August 28, 2012, for Possession of Child Pornography. He appeared before U.S. Magistrate Judge Veronica L. Duffy on September 10, 2012, and pled not guilty to the indictment. The penalty upon conviction is a minimum of 10 years and a maximum of 20 years' imprisonment. The charge is merely an accusation, and Whiting is presumed innocent until and unless proven guilty. The investigation is being conducted by the South Dakota Division of Criminal Investigation. Assistant U.S. Attorney Sarah B. Collins is prosecuting the case. Whiting was remanded to the custody of the U.S. Marshal. A trial date has not yet been set. |
