United States Attorney Brendan V. Johnson announced that a Keystone man charged with Unlawful Taking of Wildlife pled guilty and was sentenced on November 9, 2012, by U.S. Magistrate Judge Veronica L. Duffy. Henry J. Martens, Jr., age 27, was sentenced to three years’ probation and was ordered to pay a $5,000 fine, $5,000 in restitution, and $25 to the Victim Assistance Fund.

In January 2012, Martens, while with another individual, unlawfully shot and killed two bull elk at Wind Cave National Park during the night.

This case was investigated by the National Park Service, South Dakota Game, Fish and Parks, and the Pennington County Sheriff’s Office. Assistant U.S. Attorney Eric Kelderman prosecuted the case.
