Texas Man Indicted on Conspiracy to Distribute a Controlled Substance

United States Attorney Brendan V. Johnson announced that a Texas man was indicted by a federal grand jury for conspiracy to distribute a controlled substance.

James Boyter, age 45, was indicted on September 25, 2012, for conspiracy to distribute a controlled substance.  He appeared before U.S. Magistrate Judge Veronica L. Duffy on December 7, 2012, and pled not guilty to the indictment.  The penalty upon conviction is not less than 10 years and up to life imprisonment and/or $10,000,000 fine.  The charge is merely an accusation, and James Boyter is presumed innocent until and unless proven guilty. 

The investigation is being conducted by Immigration and Customs Enforcement.  Assistant U.S. Attorney Ted McBride is prosecuting the case.  James Boyter was remanded to the custody of the U.S. Marshal.  A trial date has not yet been set.
