 Buckhannon Resident Indicted on Firearms Violation
    
ELKINS, WEST VIRGINIA — A 39 year old Buckhannon, West Virginia, resident was indicted today (August 11, 2009) by a Federal Grand Jury sitting in Elkins, West Virginia.
United States Attorney Sharon L. Potter announced that KIRK C. GUTH was named in a one-count Indictment. The Indictment alleges that GUTH, having been previously convicted of a crime punishable by imprisonment for a term exceeding one year, knowingly possessed a firearm on December 8, 2006, in Upshur County which had been shipped in interstate commerce.
If convicted, GUTH faces a maximum penalty of 10 years imprisonment and a fine of $250,000.
The case will be prosecuted by Assistant United States Attorney Stephen D. Warner. The case was investigated by the Bureau of Alcohol, Tobacco, Firearms & Explosives.
It should be noted that the charges contained in the Indictment are merely accusations and not evidence of guilt, and that each defendant is presumed innocent until and unless proven guilty.
