Three Defendants Sentenced
for Violations of Federal Laws

ELKINS, WEST VIRGINIA — Three defendants were sentenced on January 13 and 15, 2009, in United States District Court in Elkins by Judge Robert E. Maxwell.

United States Attorney Sharon L. Potter announced that:

JAMES FRANCIS KENNEY, age 48, of Hico, West Virginia, was sentenced to two years probation. KENNEY entered a plea of guilty on August 21, 2008, to using the public telephone system to distribute morphine on May 10, 2006, near Beverly, West Virginia. The case was investigated by the West Virginia State Police - Bureau of Criminal Investigations.

ANITA J. DEFIBAUGH, age 60, of Mill Creek, West Virginia, was sentenced to one year probation and was ordered to pay restitution in the amount of $606.05. DEFIBAUGH, a postal service employee, entered a plea of guilty on October 30, 2008, to converting $606.05 in Postal Service monies to her own use from January 2008, to July 2008, in Mill Creek. The case was investigate by the United States Postal Inspection Service - Office of Inspector General.

ANCIL E. PARKS, age 58, of Marlinton, West Virginia, was sentenced to three years probation and was ordered to pay restitution in the amount of $2,179.38. PARKS, a postal service employee, entered a plea of guilty on June 25, 2008, to converting $2,179.38 in Postal Service monies to his own use from August 2007 to March 7, 2008, in Pocahontas County. The case was investigated by the United States Postal Inspection Service - Office of Inspector General.

The cases were prosecuted by Assistant United States Attorney Stephen D.
