Nine Individuals Sentenced On
Various Federal Violations

MARTINSBURG, WEST VIRGINIA — Nine individuals were sentenced on July 13 and July 14, 2009, in United States District Court in Martinsburg by Chief Judge John Preston Bailey.

United States Attorney Sharon L. Potter announced that:

MELVIN GARY ELLIS, JR., age 26, of Berkeley Springs, West Virginia, was sentenced to 60 months imprisonment to be followed by four years supervised release. ELLIS entered a plea of guilty on April 2, 2009, to a one-count Information charging him with possession with intent to distribute cocaine base on December 19, 2008, in Martinsburg. ELLIS is in federal custody. The case was prosecuted by Assistant United States Attorney Paul T. Camilletti. The case was investigated by the Martinsburg Police Department and the Jefferson County Sheriff’s Department.

TIMOTHY DOUGLAS IMPERIO, age 28, of Keyser, West Virginia, was sentenced to 30 months imprisonment to be followed by three years supervised release. IMPERIO entered a plea of guilty on April 28, 2009, to one count of an Indictment charging him with perjury after appearing before a federal grand jury in September 2008 and testifying falsely concerning his knowledge about the drug trafficking activities and his own involvement in those activities. IMPERIO is in federal custody. The case was prosecuted by Assistant United States Attorney Thomas O. Mucklow. The case was investigated by the Potomac Highlands Drug & Violent Crime Task Force, consisting of officers from the Federal Bureau of Investigation, West Virginia State Police - Bureau of Criminal Investigations, and Mineral County Sheriff’s Department.

MATTHEW JENKINS, age 36, of Charles Town, West Virginia, was sentenced to 41 months imprisonment to be followed by three years supervised release. JENKINS entered a plea of guilty on May 18, 2009, to one count of an Indictment charging him with the distribution of cocaine base on May 1, 2008, in Jefferson County. JENKINS is currently free on bond and will self-report to a designated federal institution. The case was prosecuted by Assistant United States Attorney Paul T. Camilletti. The case was investigated by the Charles Town Police Department and the Bureau of Alcohol, Tobacco, Firearms & Explosives.

JILL MALCOLM, age 27, of Capon Bridge, West Virginia, was sentenced to five years probation. MALCOLM entered a plea of guilty on November 6, 2008, to one count of an Indictment charging her with aiding and abetting the distribution of cocaine hydrochloride on April 21, 2008. The case was prosecuted by Assistant United States Attorney Paul T. Camilletti. The case was investigated by the Bureau of Alcohol, Tobacco, Firearms & Explosives.

DARLENE PAOLO, age 43, of Martinsburg, was sentenced to three years probation. PAOLO entered a plea of guilty on January 22, 2009, to an Information charging her with possessing methamphetamine on October 29, 2008, in Martinsburg. The case was prosecuted by Assistant United States Attorney Paul T. Camilletti. The case was investigated by the Washington County Drug Task Force.

ROBERT NICHOLAS ROSS, age 33, of Jefferson County, was sentenced to 180 months imprisonment. ROSS entered a plea of guilty on April 17, 2009, to one count of being a convicted felon in possessing of firearms on June 12, 2007, in Kearneysville. The case was prosecuted by Assistant United States Attorney Paul T. Camilletti. The case was investigated by the West Virginia State Police and the Bureau of Alcohol, Tobacco, Firearms & Explosives.

JESUS AREGUIN RUBIO, age 25, of Martinsburg, was sentenced to 41 months imprisonment. RUBIO entered a plea of guilty on April 3, 2009, to one count of illegally re-entering the United States without permission from the Attorney General of the United States or the Secretary of Homeland Security. RUBIO’s status as an illegal alien was discovered while incarcerated at the Eastern Regional Jail on February 3, 2009. He was most recently deported in September 2008. The case was prosecuted by Assistant United States Attorney Paul T. Camilletti. The case was investigated by the Charles Town Police Department and the United States Immigration and Customs Enforcement.

ROY DALE STEELE, age 47, of Martinsburg, was sentenced to four years probation. STEELE entered a plea of guilty on April 3, 2009, to one count of an Indictment charging him with the distribution of heroin on September 20, 2006, in Martinsburg. The case was prosecuted by Assistant United States Attorney Thomas O. Mucklow. The case was investigated by the Eastern Panhandle Drug & Violent Crimes Task Force, consisting of officers from the West Virginia State Police - Bureau of Criminal Investigation, the Martinsburg Police Department, and the Berkeley County Sheriff’s Department.

JONATHAN KEITH WORKMAN, age 29, of Martinsburg , was sentenced to 12 months and one day imprisonment to be followed by three years supervised release and was ordered to pay restitution in the amount of $130,832.93 . WORKMAN entered a plea of guilty on January 22, 2009, to one count of unauthorized use of access devices with the intent to defraud. Between March of 2003 and August of 2006, WORKMAN opened a total of 11 accounts with five different banking institutions and obtained credit cards on each account in the names of other persons. WORKMAN then used these credit cards to obtain goods and services to pay for day to day living expenses, to finance his business, and to support his personal marijuana use. WORKMAN is currently free on bond and will self-report to a designated federal institution. The case was prosecuted by Assistant United States Attorney Thomas O. Mucklow. The case was investigated by the Martinsburg Police Department and the United States Secret Service.
