Cross Junction, Virginia, Resident Entered Guilty Plea
To Unlawfully Possessing a Firearm

MARTINSBURG, WEST VIRGINIA — A 24 year old Cross Junction, Virginia, resident entered a plea of guilty on May 5, 2009, in United States District Court in Martinsburg before Magistrate Judge David J. Joel.

United States Attorney Sharon L. Potter announced that JAMES WAYNE NICHOLSON entered a plea of guilty to an Indictment charging him with being a felon in possession of a firearm. The charge arose from a traffic stop on a vehicle operated by NICHOLSON in Jefferson County, West Virginia, when a search of the vehicle yielded a loaded .22 caliber pistol along with ammunition. NICHOLSON, who was previously convicted of four felony offenses, was prohibited from possessing a firearm.

NICHOLSON, who is currently free on bond pending sentencing, faces a maximum penalty of 10 years imprisonment and a fine of $250,000.

The case was prosecuted by Assistant United States Attorney Erin K. Reisenweber. The case was investigated by the Bureau of Alcohol, Tobacco, Firearms & Explosives.
