Linn, West Virginia, Resident Indicted on
Embezzlement Charge

CLARKSBURG, WEST VIRGINIA — A 55 year old Linn, West Virginia, resident was named in an Indictment returned by a Federal Grand Jury sitting in Clarksburg, West Virginia, on September 1, 2009.

United States Attorney Sharon L. Potter announced that BRIAN KEITH POWERS was named in a one-count Indictment. The Indictment alleges that POWERS embezzled and converted to his own use monies of the Social Security Administration, namely Social Security payments to which he knew he was not entitled, having a value of $18,037.09, from January 11, 2005, through January 24, 2007.

If convicted, POWERS faces a maximum penalty of 10 years imprisonment and a fine of $250,000.

The case will be prosecuted by Assistant United States Attorney Shawn Angus Morgan. The case was investigated by the Social Security Administration - Office of Inspector General and United States Secret Service.

It should be noted that the charges contained in the Indictment are merely accusations and not evidence of guilt, and that each defendant is presumed innocent until and unless proven guilty.
