Martinsburg Resident Enters Plea of Guilty to Embezzlement

MARTINSBURG, WEST VIRGINIA — A 45 year old Martinsburg, West Virginia, resident entered a plea of guilty on December 13, 2010, in United States District Court in Martinsburg before Magistrate Judge David J. Joel.

United States Attorney William J. Ihlenfeld, II, announced that SHERRY LYNN HILL entered a plea of guilty to embezzlement of $31,766.20 from Stinger Sheet Metal, Inc. SIMPLE IRA Plan, an employee pension benefit plan, from January 1, 2006, through December 31, 2008, in Berkeley County, West Virginia. HILL was the fiduciary for the employee benefit plan and failed to remit the employee contributions to the IRA plan, even though these monies were withheld from payroll. As part of her plea, HILL will make restitution to the plan in the amount of $31,766.20.

The case was prosecuted by Assistant United States Attorney Paul T. Camilletti. The case was investigated by the United States Department of Labor.
