Three Buckhannon Residents Sentenced on Meth Charges

ELKINS, WEST VIRGINIA — Three Buckhannon, West Virginia, residents were sentenced on March 8, 2010, in United States District Court in Elkins by Chief Judge John Preston Bailey.

Acting United States Attorney Betsy C. Jividen announced that:

JEREMY TODD BROWN, age 34, was sentenced to 360 months imprisonment to be followed by five years supervised release and was ordered to pay restitution to the Drug Enforcement Administration in the amount of $6,425. BROWN was convicted at trial in September 2009 on three counts of a Superseding Indictment charging him with conspiring to possess with intent to distribute and to manufacture more than 50 grams of substances containing methamphetamine from the Fall of 2007 to July 7, 2009, in Upshur County, West Virginia; possession of material used in the manufacture of methamphetamine; and possessing Pseudoephedrine to be used in the manufacture of methamphetamine. BROWN is in federal custody.

BRUCE ALAN DAVIDSON, JR., age 29, was sentenced to 235 months imprisonment to be followed by four years supervised release and was ordered to pay restitution to the Drug Enforcement Administration in the amount of $6,425. DAVIDSON entered a plea of guilty on September 18, 2009, to one count of a Superseding Indictment charging him with conspiracy to possess with intent to distribute, and to manufacture more than 50 grams of substances containing methamphetamine from the Fall of 2007 to July 7, 2009, in Upshur County. DAVIDSON is in federal custody.

The case was investigated by the Upshur County Sheriff’s Office; the West Virginia State Police - Bureau of Criminal Investigation; and the Harrison/Lewis County Drug & Violent Crime Task Force, consisting of officers from the Clarksburg Police Department, the Harrison County Sheriff’s Department, the Bridgeport Police Department, the Lewis County Sheriff’s Department, and the Drug Enforcement Administration.

WESLEY MAYES, age 21, was sentenced to 30 months imprisonment to be followed by three years supervised release. MAYES entered a plea of guilty on October 13, 2009, to one count of an Indictment charging him with conspiring to possess equipment, chemical, and material to be used to manufacture methamphetamine from July 31, 2008, to July 23, 2009, in the Northern District of West Virginia. MAYES is currently free on bond and will self-report to a designated federal institution. The case was investigated by the Upshur County Sheriff’s Department.

“During the past year, the Upshur County Sheriff’s Department and the West Virginia State Police - Bureau of Criminal Investigation, with assistance from the Upshur County Prosecuting Attorney’s Office, worked tirelessly and cooperatively with federal, state, and local law enforcement agencies to tackle the methamphetamine problem in Upshur County. As a result of the cooperation at all levels, 19 defendants have been prosecuted and sentenced in federal court in Elkins for their role in manufacturing methamphetamine,” stated Acting USA Jividen. “In addition to the law enforcement agencies listed in this release, the law enforcement effort in Upshur County received assistance from the Preston County Sheriff’s Department; the Barbour County Sheriff’s Department; the Granville Police Department; the Buckhannon Detachment of the West Virginia State Police; the Bureau of Alcohol, Tobacco, Firearms & Explosives; and the Drug Enforcement Administration.”

The cases were prosecuted by Assistant United States Attorney Stephen D. Warner.
