Seven Individuals Sentenced in Federal Court

MARTINSBURG, WEST VIRGINIA — Seven individuals were sentenced this week in United States District Court in Martinsburg by Chief Judge John Preston Bailey.

United States Attorney William J. Ihlenfeld, II, announced that:

MICHAEL LYNN ROBINSON, age 43, of Berkeley Springs, West Virginia, was sentenced on October 26, 2010, to 110 months imprisonment to be followed by three years of supervised release. ROBINSON entered a plea of guilty on July 1, 2010, to one count of felon in possession of a firearm on July 28, 2008, in Morgan County, after having been arrested on State charges and found to be in possession of a .22 caliber revolver. ROBINSON was remanded to the custody of the United States Marshal. This case was prosecuted by Assistant United States Attorney Paul T. Camilletti and was investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives and the Morgan County Sheriff’s Department.

ARTHUR LEE HAIRSTON, JR., age 32, of Martinsburg, West Virginia, was sentenced on October 26, 2010, to 63 months imprisonment to be followed by three years of supervised release. HAIRSTON entered a plea of guilty on July 1, 2010, to one count of felon in possession of a firearm on December 11, 2009, in Martinsburg, after a traffic stop revealed he possessed a 9 mm pistol. HAIRSTON prior conviction is a drug offense in the Northern District of West Virginia. HAIRSTON was remanded to the custody of the United States Marshal. This cases was prosecuted by Assistant United States Attorney Paul T. Camilletti and were investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives and the Martinsburg Police Department.

ROGELIO PORTILLO-VAZQUEZ, age 32, of Charles Town, West Virginia, was sentenced on October 26, 2010, to 37 months imprisonment, to be followed by three years of supervised release. PORTILLO-VAZQUEZ entered a plea of guilty on August 6, 2010, to one count of distribution of cocaine on September 4, 2009, in Berkeley County, West Virginia. PORTILLO-VAZQUEZ was remanded to the custody of the United States Marshal.

FERNANDO BUSTROS FLORES, age 36, of Purcellville, Virginia, was sentenced on October 26, 2010, to 24 months imprisonment, to be followed by three years of supervised release. FLORES entered a plea of guilty on June 23, 2010, to one count of distribution of cocaine on April 5, 2010, in Jefferson County, West Virginia. FLORES was remanded to the custody of the United States Marshal.

These cases were prosecuted by Assistant United States Attorney Erin K. Reisenweber and were investigated by the Eastern Panhandle Drug & Violent Crime Task Force, consisting of officers from the West Virginia State Police - Bureau of Criminal Investigation, the Martinsburg Police Department, and the Berkeley County Sheriff’s Department.

ELAN BELL VENEY, age 24, of Martinsburg, was sentenced on October 26, 2010, to 15 months imprisonment to be followed by three years of supervised release. VENEY entered a plea of guilty on August 4, 2010, to one count of possession of a firearm by a drug user on May 10, 2009, in Martinsburg, after a traffic stop revealed a firearm and marijuana in the vehicle. VENEY was remanded to the custody of the United States Marshal. This case was prosecuted by Assistant United States Attorney Paul T. Camilletti and was investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives, the Charles Town Police Department and the Berkeley County Sheriff’s Department.

RODRIGO ALFONSO CONTRERAS-GODINEZ, age 26, formerly of El Salvador, was sentenced on October 25, 2010, to time served since May 27, 2010, to be followed by one year of supervised release. CONTRERAS-GODINEZ entered a plea of guilty on September 22, 2010, to one count of reentry into the United States without the consent of the Secretary of Homeland Security nor the Attorney General of the United States to reapply for admission to the United States, after having been deported on June 24, 2004. CONTRERAS-GODINEZ was encountered in the United States on May 27, 2010, in Berkeley County and had not sought permission to re-enter the United States. CONTRERAS-GODINEZ was remanded to the custody of Immigration and Customs Enforcement to await deportation. The case was prosecuted by Assistant United States Attorney Erin K. Reisenweber and was investigated by the Department of Homeland Security – Immigration and Customs Enforcement.

DOMENIC COLANDREA, age 43, of Martinsburg, was sentenced on October 26, 2010, to 2 years probation and a fine of $10,000. COLANDREA entered a plea of guilty on May 20, 2010, to one count of unlawfully failing to report approximately $540,000 of income, resulting in a tax loss of $151,200. The case was prosecuted by Assistant United States Attorney Andrew R. Cogar and was investigated by the Internal Revenue Service-Criminal Investigations.
