Eight Sentenced for Revocation of Supervised Release

WHEELING, WEST VIRGINIA - United States Attorney William J. Ihlenfeld, II, announced the recent sentencings of eight individuals after their supervised release was revoked for various violations.

The specific information is as follows:

ANGELA SUE HODGE, age 36, of Martinsburg, West Virginia, was sentenced by Chief Judge John Preston Bailey to 12 months and one day imprisonment to be followed by two years supervised release for violations of her supervised release for failure to obey the rules of a community corrections facility as required; testing positive for oxycodone; associating with a person engaged in criminal activity; testing positive for cocaine and oxycodone; failure to notify the Probation Officer of change of address; and failure to report to the Probation Officer as required. HODGE was initially sentenced to 18 months imprisonment to be followed by three years supervised release for the distribution of “crack” cocaine. HODGE is in federal custody. The United States Attorney’s Office was represented at the hearing by Assistant United States Attorney Thomas O. Mucklow.

RALPH JUNIOR HUMPHRIES, age 37, of Philippi, West Virginia, was sentenced by Chief Judge Bailey to 12 months and one day imprisonment for violations of the conditions of his supervised release by changing his residence and employment without notifying his Probation Oficer; and failure to report to the Probation Office as required. HUMPHRIES was initially sentenced on April 29, 2003, to 27 months imprisonment to be followed by six years supervised release for distributing cocaine base, also known as “crack” within 1,000 feet of a school. HUMPHRIES was remanded to the custody of the United States Marshal. The United States Attorney’s Office was represented at the hearing by Assistant United States Attorney Stephen D. Warner.

RUSSELL GREGG KELLEY, age 57, was sentenced by Judge Irene M. Keeley to 18 months imprisonment for violations of the conditions of his supervised release after testing positive for the use of drugs and being in possession of drug paraphernalia, as well as not being able to give a valid explanation as to why he was continually short of his medication. KELLEY was initially sentenced to 37 months imprisonment for maintaining a drug premise. KELLEY was remanded to the custody of the United States Marshal. The United States Attorney’s Office was represented at the hearing by Assistant United States Attorney Brandon S. Flower.

TIMOTHY MILBURN, age 25, of Martinsburg, was sentenced by Chief Judge Bailey to eight months imprisonment to be followed by 28 months supervised release for failure to report to the Probation Officer as required; testing positive for morphine; being convicted of speeding and driving on a suspended license; failure to report change of employment; conviction of a seatbelt violation and failure to report the arrest to the Probation Officer; and testing positive for benzodiazepine, codeine, and oxycodone. MILBURN was initially sentenced to 12 months and one day imprisonment to be followed by three years supervised release for the distribution of “crack” cocaine. MILBURN is in federal custody. The United States Attorney’s Office was represented at the hearing by Assistant United States Attorney Thomas O. Mucklow.

CHRISTOPHER MINNIS, age 26, of Morgantown, West Virginia, was sentenced by Judge Keeley to 24 months imprisonment for violations of the conditions of his supervised release after being convicted in Monongalia County of malicious assault and 2nd degree sexual assault; traveling out of state without permission, and failure to report for drug testing. MINNIS was initially sentenced to 13 months imprisonment for conspiracy to possess marijuana with the intent to distribute. MINNIS was remanded back to state custody, and his federal sentence will be served consecutive to his state sentences. The United States Attorney’s Office was represented at the hearing by Assistant United States Attorney Brandon S. Flower.

ROBERT ROBERTSON, of Wheeling, was sentenced by Judge Frederick P. Stamp, Jr. to two months imprisonment, to be followed by one year of supervised release for violations of the conditions of his supervised release by terminating his employment without providing the Probation Officer 10 days prior notice of change in his employment status; testing positive for cocaine on February 5, 2011; and possession of cocaine on April 6, 2011. ROBERTSON was initially sentenced on December 6, 2004, to 18 months imprisonment to be followed by six years of supervised release for the distribution of “crack” cocaine within 1,000 feet of a public housing facility. ROBERTSON was remanded to the custody of the United States Marshal. The United States Attorney’s Office was represented at the hearing by Assistant United States Attorney John C. Parr.

MARY JANE ROSE, age 39, of Elkins, West Virginia, was sentenced by Chief Judge Bailey to 12 months and one day imprisonment for violations of the conditions of her supervised release by testing positive for the use of methamphetamine on three occasions. ROSE was initially sentenced on August 30, 2006, to 37 months imprisonment to be followed by three years supervised release for the attempt to manufacture methamphetamine. ROSE was remanded to the custody of the United States Marshal. The United States Attorney’s Office was represented at the hearing by Assistant United States Attorney Stephen D. Warner.

JASON LLOYD YAIDER, age 35, of Ridgeley, West Virginia, was sentenced by Chief Judge Bailey to five months imprisonment to be followed by 19 months of supervised release after being convicted of 2nd offense DUI and 1st offense driving revoked for which he was sentenced to one year in jail. YAIDER was initially sentenced to three months imprisonment to be followed by three years supervised release for possessing a firearm after a misdemeanor conviction of domestic violence. YAIDER will self-report to a designated federal institution. The United States Attorney’s Office was represented at the hearing by Assistant United States Attorney Erin K. Reisenweber.
