Six Individuals Sentenced in Federal Court

ELKINS, WEST VIRGINIA - Six individuals were sentenced this week in United States District Court in Elkins by Chief Judge John Preston Bailey.

United States Attorney William J. Ihlenfeld, II, announced that:

CHARLES CUTRIGHT, age 39, of Buckhannon, West Virginia, was sentenced on November 28, 2011, to 120 months imprisonment to be followed by three years of supervised release. CUTRIGHT entered a plea of guilty on August 24, 2011, to one count of an Indictment charging him with aiding and abetting the distribution of methamphetamine on November 19, 2009, in Upshur County. CUTRIGHT was remanded to the custody of the United States Marshal. The case was investigated by the West Virginia State Police-Bureau of Criminal Investigation and the Upshur County Sheriff’s Department.

LARRY DAYTON BAILEY, age 34, of Ireland, West Virginia, was sentenced on November 28, 2011,to 57 months imprisonment to be followed by three years of supervised release. BAILEY entered a plea of guilty on June 27, 2011, to one count of the Indictment charging him with possession of materials used to manufacture methamphetamine on April 21, 2010, in Randolph County, West Virginia. BAILEY, who is free on bond, will self-report to the designated Federal institution on January 5, 2012. This case was investigated by the Randolph County Sheriff’s Department.

BILLY GEORGE LEARY, JR., age 30, of Elkins, West Virginia, was sentenced on November 28, 2011, to 50 months imprisonment to be followed by three years of supervised release. LEARY entered a plea of guilty on September 13, 2011, to one count of distribution of marijuana on December 10, 2010, in Elkins and to committing violations of his probation, which commenced on November 6, 2006, by committing another federal, state or local crime; possessing a controlled substance; and, distributing a controlled substance. The case was investigated by the Randolph County Sheriff’s Department, the Elkins Detachment of the West Virginia State Police and the West Virginia State Police-Bureau of Criminal Investigations.

JAMES ROBERT SHAVER, age 47, of Buckhannon, West Virginia, was sentenced on November 28, 2011, to 16 months imprisonment to be followed by one year of supervised release. SHAVER entered a plea of guilty on August 19, 2011, to one count of an Indictment charging him with the illegal use of a telephone to facilitate the distribution of methamphetamine on May 5, 2010, in Buckhannon. SHAVER was remanded to the custody of the United States Marshal. The case was investigated by the Upshur County Sheriff’s Department and the West Virginia State Police-Bureau of Criminal Investigations.

FOSTER GAY WILLIAMS, III, age 37, of Junior, West Virginia, was sentenced on November 29, 2011, to 120 months imprisonment to be followed by three years of supervised release. WILLIAMS entered a plea of guilty on June 3, 2011, to one count of an Indictment charging him with conspiracy to manufacture methamphetamine from December of 2010 to April of 2011 in Randolph County. WILLIAMS was remanded to the custody of the United States Marshal. The case was investigated by the Junior Police Department and the West Virginia State Police.

ROBERT JAMES TAYLOR, age 25, of Buckhannon, West Virginia, was sentenced on November 29, 2011, to 18 months imprisonment to be followed by two years of supervised release. TAYLOR entered a plea of guilty on June 3, 2011, to one count of an Indictment charging him with assaulting and resisting Deputy United States Marshals who were engaged in the performance of their official duties on January 27, 2011, in Upshur County. TAYLOR was remanded to the custody of the United States Marshal. This case was investigated by the United States Marshals Service.
