Five Individuals Were Sentenced
During the Month of January
for Federal Supervised Release Violations

WHEELING, WEST VIRGINIA - United States Attorney William J. Ihlenfeld, II, announced the recent sentencings of three individuals after their supervised release was revoked for various violations.

The specific information is as follows:

ROBERT ARTHUR CAIN, JR., age 35, of Elkins, West Virginia, was sentenced by Chief Judge John Preston Bailey to 12 months and 1 day imprisonment for failure to participate in a drug and alcohol program as directed by his probation officer; failure to refrain from excessive use of alcohol or frequent establishments that serve alcohol by the drink; and failure to be truthful with his probation officer. CAIN was originally sentenced in 2007 to 37 months imprisonment and 3 years of supervised release for possession with intent to distribute methamphetamine and marijuana. CAIN, was remanded to the custody of the United States Marshal pending designation to a Federal institution. The United States Attorney’s Office was represented at the hearing by Assistant United States Attorney Stephen D. Warner.

JAMES WEGMAN, age 48, of Elkins, was sentenced by Chief Bailey to 10 months imprisonment for failure to answer truthfully all inquiries made of him by his probation officer and failure to refrain from excessive use of alcohol or frequent establishments that serve alcohol by the drink. WEGMAN was originally sentenced in 2008 to 24 months imprisonment and 3 years of supervised release for the distribution of methamphetamine. WEGMAN’s supervised release was revoked in 2010 and he was sentenced to 12 months imprisonment and 2 years of supervised release for prior violations of his supervised release. WEGMAN was remanded to the custody of the United States Marshal pending designation to a Federal institution. The United States Attorney’s Office was represented at the hearing by Assistant United States Attorney Stephen D. Warner.

DAVID JOHNSON, age 41, of Clarksburg, West Virginia, was sentenced by Judge Irene M. Keeley to 4 months imprisonment to be followed by 32 months of supervised release for illegal possession of a controlled substance; unlawful usage of a controlled substance; and, providing false information to his probation officer. JOHNSON was originally sentenced in 2008 to 4 months imprisonment and 3 years supervised release for conspiracy to violate federal firearms laws. JOHNSON was remanded to the custody of the United States Marshal pending designation to a Federal institution. The United States Attorney’s Office was represented at the hearing by Assistant United States Attorney Shawn A. Morgan.

JUSTIN GRANTHAM, age 27, of Clarksburg, was sentenced by Judge Keeley to 6 months imprisonment for failure to abide by release conditions imposed at Bannum Place by possessing a cell phone which is a prohibited object; deviating from approved schedule; and, failure to truthfully answer probation officer’s questions. GRANTHAM was originally sentenced in 2006 to 15 months imprisonment and 3 years supervised release for making a telephone threat to use an explosive to damage West Virginia University Hospital. This was the second revocation for GRANTHAM who was sentenced in 2009 to 18 months imprisonment and 18 months supervised release for attempted 1st degree robbery and possessing a knife during that offense. GRANTHAM was remanded to the custody of the United States Marshal pending designation to a Federal institution. The United States Attorney’s Office was represented at the hearing by Assistant United States Attorney Shawn A. Morgan.

JAY ARTHUR ISALY, age 38, of Wheeling, West Virginia, was sentenced by Judge Frederick P. Stamp, Jr. to 5 months imprisonment for a conviction of domestic battery; failure to follow instructions of his probation officer; possession of dangerous weapons; and, witness tampering. ISALY was originally sentenced in 2006 to 30 months imprisonment and 3 years of supervised release for being a convicted felon in possession of a firearm. ISALY will self-report to the designated Federal institution on February 29, 2012. The United States Attorney’s Office was represented at the hearing by Assistant United States Attorney David J. Perri.
