Three Individuals Sentenced and One Individual
Enters Pleas in Federal Court

WHEELING, WEST VIRGINIA — Three individuals were sentenced and one individual entered pleas of on March 12, 2012, in United States District Court in Wheeling by Judge Frederick P. Stamp, Jr.

United States Attorney William J. Ihlenfeld, II announced that:

JEREMY T. DUGAN, age 33 of Pittsburgh, Pennsylvania, was sentenced to 151 months imprisonment to be followed by three years of supervised release. DUGAN entered pleas of guilty on December 28, 2011, to three counts of bank robbery being on August 31, 2011, at the First Commonwealth Bank in Oakdale, Pennsylvania; on September 2, 2011, at the First Choice America Community Federal Credit Union in Elm Grove, West Virginia; and, on September 26, 2011, at the PNC Bank in Perryville, Maryland. As part of his plea, DUGAN agreed to the forfeiture of $5,900 stolen from the First Choice America Community Federal Credit Union and $2,496 stolen from the PNC Bank. DUGAN was remanded to the custody of the United States Marshal pending designation to a Federal institution. The case was prosecuted by Assistant United States Attorney Robert H. McWilliams, Jr. and was investigated by the Federal Bureau of Investigation.

CESAR E. GARCIA, age 28, of San Diego, California, was sentenced to 37 months imprisonment to be followed by three years of supervised release. GARCIA entered a plea of guilty on January 11, 2012, to one count of being a felon in possession of a firearm. GARCIA, having previously been convicted of Second Degree Burlary in 2004 and transportation of a controlled substance in 2009, in the Superior Court of California, County of San Diego, knowingly possessed a Winchester Model 24 20 gauge shotgun on January 15, 2011, in Glen Dale, West Virginia. As part of his plea, GARCIA also agreed to the forfeiture of the Winchester shotgun. GARCIA was remanded to the custody of the United States Marshal pending designation to a Federal institution. The case was prosecuted by Assistant United States Attorney Robert H. McWilliams, Jr. and was investigated by the Bureau of Alcohol, Tobacco, Firearms & Explosives.PRESS RELEASE

STEPHEN A. MORRIS, age 42, of Roanoke, Virginia, was sentenced to 27 months imprisonment to be followed by three years of supervised release. MORRIS entered a plea of guilty on December 29, 2011, to one count of attempted transfer of obscenity to a minor from June 3 to June 16, 2011, in Moundsville, West Virginia. MORRIS, who is free on bond, will self-report to the designated Federal institution on April 12, 2012. The case was prosecuted by Assistant United States Attorney David J. Perri and was investigated by the Marshall County Sheriff’s Department.

MICHAEL TIMBERLAKE, age 28, of Bridgeport, Ohio, entered pleas of guilty to one count of Interstate Domestic Violence on November 7, 2011, and one count of transportation of a stolen firearm in interstate commerce from Bridgeport, Ohio, to Wheeling, West Virginia. TIMBERLAKE, who is in custody pending sentencing, faces a maximum exposure of 10 years imprisonment and a fine of $250,000 on each count. The case was prosecuted by Assistant United States Attorney Randolph J. Bernard and was investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives.
