Two Individuals Enter Pleas to Use of
a Counterfeit Access Device

MARTINSBURG, WEST VIRGINIA - Two individuals entered pleas of guilty in United States District Court in Martinsburg on November 28, 2012, before Magistrate Judge David J. Joel.

United States Attorney William J. Ihlenfeld, II, announced that:

CARLOS GAUSE, age 38, of Wilmington, North Carolina, entered a plea of guilty to “Use of a Counterfeit Access Device” on March 14, 2010, at the casino in Charles Town, West Virginia, when GAUSE presented photographic identification along with a counterfeit credit card in order to obtain a cash advance of $1,000. As part of his plea, GAUSE has agreed to make restitution in the amount of $155,300 to the casino.

DWAYNE FLEMING, age 38, of Brooklyn, New York, entered a plea of guilty to “Use of a Counterfeit Access Device” on April 3, 2010, at the casino in Charles Town, West Virginia, when FLEMING presented photographic identification along with a counterfeit credit card in order to obtain a cash advance of $1,000. As part of his plea, FLEMING has agreed to make restitution in the amount of $34,000 to the casino.

GAUSE and FLEMING, who are in custody pending sentencing, face up to 10 years imprisonment and a fine of $250,000.

The case was prosecuted by Assistant United States Attorney Thomas O. Mucklow and investigated by the West Virginia State Police and United States Secret Service.
