Three Individuals Sentenced in Federal Court

ELKINS, WEST VIRGINIA - Three individuals were sentenced on October 23, 2012, in United States District Court in Elkins before Chief Judge John Preston Bailey.

United States Attorney William J. Ihlenfeld, II, announced that:

LARRY JAMES MARTIN, age 35, of Moorefield, West Virginia, was sentenced to 120 months imprisonment to be followed by three years of supervised release. MARTIN entered
a plea of guilty on July 24, 2012, to Possession of Material Used in the Manufacture of Methamphetamine on September 7, 2011, in Hardy County. MARTIN was also ordered by the Court to make restitution in the amount of $1,522.62. MARTIN, who is free on bond, will self-report to the designated Federal institution.

This case was investigated by the United States Forest Service, West Virginia State Police, Pendleton County Sheriff’s Department, Grant County Sheriff’s Department, Hardy County Sheriff’s Department and the Petersburg Police Department.

STACEY AUSTIN GARDINER, age 42, of Franklin, West Virginia, was sentenced to
72 months imprisonment to be followed by three years of supervised release. GARDINER entered a plea of guilty on June 12, 2012, to Possession of Material Used in the Manufacture of Methamphetamine on January 31, 2012, in Pendleton County, West Virginia. GARDINER was remanded to the custody of the United States Marshal pending designation to a Federal institution.

This case was investigated by the West Virginia State Police-Franklin Detachment; the
United States Forest Service and the Pendleton County Sheriff’s Department.

BREANNE MCULTY, age 22, of Petersburg, West Virginia, was sentenced to 42 months imprisonment to be followed by three years of supervised release. MCULTY entered a plea of guilty on July 24, 2012, to Making Threats to a Material Witness on April 9, 2012, in an effort to prevent the witness from testifying in an official proceeding. MCULTY was remanded to the custody of the United States Marshal pending designation to a Federal institution.

The case was investigated by the United States Forest Service, Immigration and Customs Enforcement, the Grant County Sheriff’s Department, the West Virginia State Police and the Wardensville Police Department.

All three cases were prosecuted by Assistant United States Attorney Stephen D. Warner.
