Northern Arapaho Men Indicted for Assault with a Dangerous Weapon, Arson, Burglary and Aiding and Abetting. United States Attorney Christopher A. Crofts announced that Norman Ybarra and Lamar Duran, of the Wind River Reservation appeared in federal court on October 18, 2011, after having been indicted on federal charges. Specifically, the September 22, 2011, indictment alleges that the Defendant’s committed an assault with a dangerous weapon and aided and abetted each other in the assault; that they then committed an arson of the Arapahoe Baptist Church and aided and abetted each other; and that they committed a burglary of the Arapahoe Baptist Church and aided and abetted each other. The assault charge carries a penalty of up to ten years imprisonment and a $250,000.00 fine; the arson charges carries a penalty of up to twenty-five years imprisonment and a $250,000.00 fine; and the burglary charge carries a penalty of up to ten years imprisonment and a $10,000.00 fine. Trial will be set on or near December 19, 2011, before United States District Court Judge Clarence A. Brimmer. An indictment is only an accusation. In every criminal case, the accused is presumed to be innocent until proven guilty, and the government always has the burden of proving guilt beyond a reasonable doubt.
