Sentences and Charges for March 26, 2012
Ronald York, 23, of Ethete, Wyoming, and an enrolled member of the Northern Arapaho Tribe of the Wind River Indian Reservation, was sentenced by Chief Federal District Court Judge Nancy D. Freudenthal on March 26, 2012. The Defendant pled guilty to aggravated assault, in violation of 18 USC §§ 2, 113(a)(6) and 1153, and was sentenced to 60 months imprisonment, followed by three years of supervised release, for his role in the August 5, 2011, death of John Michael Crispin III. Although statements were made by York during the investigation of this matter, that the crime was motivated by homosexual activity involving the victim, the defendant told the Court at sentencing that this allegation was not true. The Defendant was also ordered to pay restitution for the victim's funeral expenses. This case was investigated by the Federal Bureau of Investigation and the Bureau of Indian Affairs.
Anthony Lincoln, 25, of Ethete, Wyoming, and an enrolled member of the Northern Arapaho Tribe of the Wind River Indian Reservation, was sentenced by Chief Federal District Court Judge Nancy D. Freudenthal on March 26, 2012. The Defendant pled guilty to voluntary manslaughter, in violation of 18 USC §§ 1112(a) and (b) and 1153, and was sentenced to 108 months imprisonment, followed by three years of supervised release, for his role in the August 5, 2011, death of John Michael Crispin III. Although statements were made by co-defendant Ronald York during the investigation of this matter, that the crime was motivated by homosexual activity involving the victim, York told the Court at his sentencing that this allegation was not true. The Defendant was also ordered to pay restitution for the victim's funeral expenses. This case was investigated by the Federal Bureau of Investigation and the Bureau of Indian Affairs.
Allen Standing Elk, 29, of Fort Washakie, Wyoming, and an enrolled member of the Northern Arapaho Tribe of the Wind River Indian Reservation, was charged with one count of assault with a dangerous weapon with intent to do bodily harm and one count of assault resulting in serious bodily injury, in connection with allegations the defendant used a weapon to cause serious injury to the victim following a dispute. Standing Elk is also charged with one count of assault on a Federal Officer in connection with allegations he assaulted a Bureau of Indian Affairs/Wind River Police Department Corrections Officer while housed in the Wind River Police Department Detention Center. The defendant is detained pending trial in this matter. An indictment is only an accusation. In every criminal case, the accused is presumed to be innocent until proven guilty, and the government always has the burden of proving guilt beyond a reasonable doubt. This case is being investigated by the BIA/Wind River Police Department and the Federal Bureau of Investigation.
Darolin “Toby” Surrell, 42, of Fort Washakie, Wyoming, and an enrolled member of the Eastern Shoshone Tribe of the Wind River Indian Reservation, was charged with one count of assault on a Federal Officer in connection with allegations he used a dangerous weapon in assaulting a Bureau of Indian Affairs/Wind River Police Department Officer who responded to a call involving the defendant on the Wind River Indian Reservation. In every criminal case, the accused is presumed to be innocent until proven guilty, and the government always has the burden of proving guilt beyond a reasonable doubt. This case is being investigated by the BIA/Wind River Police Department and the Federal Bureau of Investigation.
Russell James Ute, 29, of Fort Washakie, Wyoming, and an enrolled member of the Eastern Shoshone Tribe of the Wind River Indian Reservation, was charged with two counts of assault on a Federal Officer for his role in two separate incidents on the Wind River Indian Reservation occurring ten days apart, and involving multiple federal law enforcement officers. In every criminal case, the accused is presumed to be innocent until proven guilty, and the government always has the burden of proving guilt beyond a reasonable doubt. This case is being investigated by the BIA/Wind River Police Department and the Federal Bureau of Investigation.
