The Denver Immigration Court falls under the jurisdiction of the Office of the Chief Immigration Judge which is a component of the Executive Office for Immigration Review under the Department of Justice. Our court has made a commitment to provide access to information through the Internet in order to service the needs of the public. Our goal is to provide the most current and accurate information available to those needing to appear before an Immigration Judge and to provide this information in a user-friendly fashion. Please note: The U.S. Citizenship and Immigration Services (USCIS) and the Executive Office for Immigration Review (EOIR) are separate organizations. About the Court The U.S. Immigration Court in Denver was established in 1983 when EOIR was created as a separate agency from the DHS. Originally, there was one judge and one clerical support staff. The interpreter responsibilities were contacted out on an as-needed basis. The court was supervised by the Court Administrator in San Francisco as a satellite office. By 1991, the court consisted of three Immigration Judges, three Clerk-Typists, and three Interpreters. In January of 1992 Judge Sellers retired and was not replaced. The administrative duties were transferred to Seattle, then San Francisco, again as a satellite office. Due to an increase in the caseload, it was decided that a full time Court Administrator was needed to oversee the office. In March of 1995, Alec Revelle was appointed the Court Administrator. Currently, the staffing for the office is as follows: six Immigration Judges, one Court Administrator, seven Legal Assistants and three Interpreters. In addition to the downtown Denver office, there are two courtrooms and support staff at the GEO detention facility in Aurora, Colorado. This office is approximately 20 miles from the Denver office. The following is a breakdown for the staffing assignments by location: GEO - three Legal Assistants and one Interpreter; downtown Denver - four Legal Assistants and two Interpreters. The Denver office is also responsible for the following detail city locations: North Dakota; South Dakota; Wyoming, and the IHP cases conducted in Canon City, Colorado. The caseload for North Dakota, South Dakota, and Wyoming is very small and is done on an "as-needed" basis. There are no set times during the year that hearings are conducted for these locations. Hearings under the IHP program in Canon City are done approximately once every other month, with a judge and interpreter traveling to this location. All filings for hearings in Denver, Colorado and Cañon City, Colorado must be made at the office in Denver. All filings for hearings at the GEO Detention Facility in Aurora, Colorado must be made at the office in Aurora. The Court does not accept any documents by fax. The court staff cannot provide telephone or copying services, nor message services for the DHS District Counsel. Public telephones are available on the first floor of the federal building for the Denver Court and in the Security/Control room at the GEO Court in Aurora.

Building Directions: The U.S. Immigration Court for Denver is located in the Byron G. Rogers Federal Building at 1961 Stout St., Room 1403, Denver, Colorado. We are at 19th and Stout, between 19th and 20th streets. From I-70 West, go to I-25 North, exit at 20th street, turn left, go to Blake, turn right at Blake to 19th, turn left on 19th to Stout. Filing Requirements

All filings, including requests for continuances and extension, minute orders, bond redetermination requests, EOIR-28 forms and applications, must be presented to the court receptionist for filing. NO FILINGS SHOULD BE TAKEN DIRECTLY TO THE IMMIGRATION JUDGES. All filings that are hand-carried to the Court must be accepted by the court receptionist, or they will be returned to the parties unfiled.

THE COURT WILL ACCEPT FILINGS BY MAIL OR BY PERSONAL SERVICE PROVIDED THE FILING CONFORMS TO THE REQUIREMENTS OF TITLE 8 CODE OF FEDERAL REGULATIONS (8 C.F.R.) AS WELL AS THE PROVISIONS SET FORTH IN THE IMMIGRATION COURT PRACTICE MANUAL. Filings requiring a fee must include an DHS fee receipt or a request for a fee waiver. If a filing fee is paid at an DHS location where the cashier does not return the filing with a fee stamp to the filer, the Court will accept a COPY OF THE FILING AND THE FEE RECEIPT provided it is received by the Court prior to the deadline established by the immigration judge and includes proof of service on the District Counsel for the DHS (a sample proof of service is attached). Please note that the DHS does not provide a fee receipt for filings mailed to them unless the sender includes a request for the receipt and a self-addressed, stamped envelope.

In addition to the filings requirements outlined in 8 C.F.R. and the Immigration Court Practice Manual, all documents submitted to the Court must be two-hole punched at the top. Furthermore, all filings must include a certificate of service on the opposing party.

Transcripts, Review of Hearing Tape(s), Review of Records of Proceedings

The Court will not provide transcripts of hearings unless a case has been appealed. Arrangements can be made for a party to review the hearing tape(s) provided such requests are submitted in writing at least one work day prior to the desired review time. In addition, copies of tapes will be provided if a request is made in writing. Telephonic requests will not be considered.

Requests to review records of proceedings can be made in writing or telephonically. Requests should be made twenty-four hours in advance.

Detained Aliens and Bond Redeterminations

The Court will generally conduct bond redetermination hearings at 8:30 a.m. every day at the GEO detention facility in Aurora. Requests for bond hearings will be held as expeditiously as possible.

Cameras and/or recording devices are not allowed. Cell phones and beepers must be turned off prior to entering the courtroom. It is not necessary for children to attend the hearing unless they are under proceedings. There is no eating or drinking in the courtrooms.
