Office of Government Information Services Is Now Open

The Department of Justice welcomes the Office of Government Information Services (OGIS) to the federal FOIA community. The Department of Justice is already working with OGIS and that cooperation will bring benefits to those within government as well as to the citizens who seek information about how their government works. The Associate Attorney General recently explained in testimony before Congress that “[a]s the Department works directly with agencies in FOIA litigation, OGIS will be mediating and resolving agency-requester disputes to avoid that litigation. As the Department fulfills its obligation to encourage agency compliance with FOIA’s requirements, we look forward to OGIS’s reviews of where agency compliance currently stands. Indeed, the Department looks forward to working with OGIS on those compliance reviews, so that the President may provide recommendations to Congress in the future.”

The Open Government Act of 2007 amended the Freedom of Information Act (5 U.S.C. 552) to create an Office of Government Information Services (OGIS) within the National Archives and Records Administration.

The OGIS will review policies and procedures of administrative agencies under FOIA, review agency compliance with FOIA, and recommend policy changes to the Congress and the President to improve the administration of FOIA. OGIS will also provide services to mediate disputes between FOIA requesters and Federal agencies.

OGIS opened in early September, with its main office at NARA in College Park, MD. The OGIS Director, Miriam Nisbet, is already working with the Department of Justice and other agencies, and with private sector stakeholders, to help define the scope of OGIS program implementation.
