On October 5, 2011, in the District of Columbia, Martin Carter, the former Chief Technology Officer of Heart Tronics, Inc., pleaded guilty to one count of conspiracy to commit mail fraud, wire fraud and obstruction of justice (Count 1: 18 U.S.C. § 371) charged in September 2011 criminal information stemming from a conspiracy to create the appearance of sales volume, revenue and other material financial and business information for a publicly traded corporation. Previously, Carter was charged by complaint with one count of making false statements to the U.S. Securities and Exchange Commission and arrested in Boca Raton, Florida, in June 2011. A status conference has been set for June 21, 2013 at 10:00 a.m. before Judge Collyer in Courtroom 8. No date has been set for sentencing.
In a related case, United States v. Mitchell J. Stein, a jury found Stein guilty on all counts on May 20, 2103. Stein was charged in a December 2011 indictment with conspiracy to commit mail and wire fraud, mail fraud, wire fraud, securities fraud, money laundering, and conspiracy to obstruct justice stemming from a five-year, multi-million dollar market manipulation fraud scheme. Also, in another related case in the Central District of California, United States v. Ajay K. Anand, Anand, a former investor in and consultant for Signalife, pleaded guilty to one count of obstruction of proceedings before the Securities and Exchange Commission (SEC) stemming from his making false and misleading statements about his knowledge of and involvement in certain activities of Signalife. Anand will be sentenced on September 12, 2013 at 8:30 a.m. before Judge John A. Kronstadt in Courtroom 750, the Edward R. Roybal Federal Building and U.S. Courthouse, 255 East Temple Street, Los Angeles, CA 90012.
