After Congressional bills become laws, Federal Departments and Agencies are responsible for implementing those laws through regulations. Regulations are developed through the Federal rulemaking process. In general, Departments and Agencies publish proposed rules for public comment in the Federal Register for at least 30 days. At the conclusion of the comment period, Departments or Agencies consider the public comments received and then issue a final rule (which is also published in the Federal Register).

Procedures for Completing Uniform Periodic Reports in Non-Small Business Cases Filed Under Chapter 11 of Title 11; Proposed Periodic Reports and Instructions

The proposed rule sets forth procedures and criteria that non-small debtors in possession and trustees shall use when accounting for the receipt, administration, and disposition of property, and providing information about the estate and its business, including statements of receipts and disbursements, as required by 11 U.S.C. §§ 1106(a)(1) and 1107(a). The proposed rule was published in the Federal Register and is available for review at www.regulations.gov. Public comments submitted by the initial deadline of January 9, 2015 are also available for review on www.regulations.gov. The proposed Periodic Report forms and instructions are not published in the Federal Register, but are available for review at the links below.

On November 30, 2015, the United States Trustee Program published a notice of public hearing on the proposed rule. The hearing will be held on February 17, 2016, to permit interested parties to express their views on the proposed rule and forms to a panel of Program officials. In addition, the comment period has been reopened, and new or supplemental comments will be accepted until February 22, 2016. Details about the public hearing and the reopened comment period are set forth in the notice, which was published in the Federal Register and is available for review at the link below and at www.regulations.gov.

The United States Trustee Program will consider all views expressed at the public hearing, the public comments and other information and will issue a Final Rule when that process is completed.

Note: Debtors in possession and trustees will be required to use the reports in all chapter 11 cases that are not small business cases. However, until this proposed rule becomes final and effective, all non-small business debtors should continue to use the periodic reporting forms currently in use in their respective jurisdictions.
