CIVIL TASK FORCE

Misc. Action No. 94-338 (HHG)

FILED
OCT 28 1996
NANCY MAYER WHITTINGTON, CLERK
US DISTRICT COURT

ORDER

Before the Court is respondents' application for a continuance of the hearing scheduled for October 31, 1996 on the petition of the Department of Justice. Respondents Time Warner Inc., PolyGram Holding, Inc., Sony Corporation of America, Bertelsmann, Inc. and EMI Music Inc. have requested a continuance until December of 1996 to enable respondents to have two counsel of their choice present their opposition.

However, as respondents are represented by six large law firms, most of which have hundreds of capable attorneys, the Court does not find that good cause has been shown to continue the hearing for six weeks merely because two of respondents' attorneys may be unavailable.

Accordingly, it is this 28th day of October, 1996, ORDERED that respondents' application for a continuance of the hearing scheduled for October 31, 1996, be and it is hereby DENIED.
