113. Delegation of Procurement Authority

Each delegation of procurement authority will include limitations of the authority along with pre-procurement instructions and approvals. Included in the delegation is authority to approve the publication of advertisements in accordance with FAR 5.503 and JAR 2805.503-70. Each delegation of authority states the limitations and levels of approvals for goods and services (i.e. copiers, av equipment, computers, etc.) required. Acquisition, relocation or release of space is not delegated to United States Attorney's Offices and can only be acquired by the Assistant Director, Facilities Management and Support Services, EOUSA.

Use of the Government-wide Commercial Credit Card (VISA) requires a separate delegation of procurement authority from the Director, Procurement Staff, JMD, (Justice Acquisition Regulation 2801.6) in accordance with the Federal Acquisition Regulations (FAR), 48 Code of Federal Regulations (CFR), Part 8 and 13 and the Justice Acquisition Regulations. Each delegation states monetary limits and other limitations of use for purchases of goods and services.

Printing of Official Court Instruments: The printing or duplication of official court instruments should always receive advance approval. Contact the Support Services Staff and the Printing Procurement Unit/JMD, Department of Justice, 950 Pennsylvania Avenue NW, Room B-254 MAIN, Washington, D.C. 20530-0001 for approval and for a requisition number. If the need is recurring, a DOJ-2 should be forwarded to the Printing Procurement Unit/JMD requesting that a contract be negotiated through the Government Printing Office for a fiscal year period. On the basis of such contracts, U.S. Attorneys may place orders directly with the public printer. (U.S. Government Printing Office, Regional Printing Procurement Offices.)

Section 915(b) of Title 28 provides that "In any civil or criminal case the court may, upon the filing of like affidavit, direct that the expense of printing the record on appeal, if such printing is required by the appellate court, be paid by the United States, and the same shall be paid when authorized by the Director of the Administrative Office of the United States Courts." Printing expenses in such cases are not payable from Department of Justice appropriations but must be paid by the Administrative Office of the U.S. Courts.
