About the Office

The Office of General Counsel (OGC) provides legal services and guidance to all components of the USMS in matters that arise in the conduct of USMS missions pursuant to 28 USC § 566, and as delegated by the Attorney General.  OGC provides legal support to the USMS by analyzing the legal implications involved in operational and policy decisions, advising and training USMS personnel on criminal, civil, and regulatory legal issues, reviewing pertinent proposed legislation, regulations, and legal process affecting USMS operations, and representing USMS in civil and administrative litigation. Within the OGC is the USMS Freedom of Information Act (FOIA) Unit, which is comprised of information disclosure attorneys, Government Information Specialists (GIS’s) and administrative professionals, and the Body Worn Camera (BWC) Group, which is comprised of contract personnel responsible for the processing USMS BWC footage for external dissemination. 

Job Description

The Office of General Counsel (OGC) seeks an Attorney Advisor, GS-14 and 15 FPL 15, to support the Agency’s BWC program.  The incumbent will review requests for USMS BWC footage and will provide detailed guidance to contract personnel responsible for redacting BWC footage for external dissemination in accordance with federal law (such as, the Freedom of Information Act). The incumbent will review BWC footage prior to external dissemination to ensure all redactions are appropriate.  The incumbent will respond to inquiries from state and federal prosecutors regarding obtaining USMS BWC footage and records in connection with prosecutions.  The incumbent will assist with the processing of Touhy requests.  In addition, the incumbent may serve as Agency counsel for civil litigations and provide litigation support in cases to Assistant U.S. Attorneys and other Department of Justice counsel who represent the USMS and its personnel in all areas of federal litigation.  The incumbent must have familiarity with reviewing and providing substantive feedback on subpoenas, protective orders, court orders, and pleadings relating to federal matters. The incumbent may also assist with the development and presentation of legal training, Congressional requests for information, and review of proposed legislation impacting USMS. 

Must be able to obtain and maintain a Top Secret security clearance.

The selectee will be expected to report in-person to the office.

Qualifications

Required Qualifications: Interested parties must possess a JD degree, be an active member of the bar in good standing (any jurisdiction) and have at least five years of post JD experience.  Applicants must also have 1) specialized experience in FOIA matters; 2) excellent academic credentials; 3) strong oral and written communication and advocacy skills; 4) superior legal research and analytical skills; 5) experience in dealing with complex legal and policy issues.  Experience at a law enforcement agency strongly preferred. 

Proficiency in computer-aided legal research and computer word processing is required. Occasional travel may be required for this position.

There is no formal rating system for applying veterans' preference to attorney appointments in the excepted service; however, the Department of Justice considers veterans' preference eligibility as a positive factor in attorney hiring.
