Health Care Fraud Section
The Fraud Division's Health Care Fraud Section is comprised of experienced white-collar prosecutors dedicated to prosecuting the nation’s most complex health care fraud matters and criminal conduct involving the illegal prescribing and dispensing of opioids and other controlled substances. The Section's core mission is to protect the public fisc, involving health care benefit programs such as Medicare, Medicaid, and TRICARE, and to protect patients from egregious fraudulent schemes that result in patient harm, including the overprescribing of controlled substances. The Section routinely prosecutes defendants who orchestrate schemes that result in the loss of hundreds of millions of dollars, the distribution of thousands of controlled substance pills, and complex money laundering, tax, and other associated financial crime offenses.
The Health Care Fraud Section is a leader in using advanced data analytics and algorithmic methods to identify newly emerging health care fraud schemes and to target the most egregious fraudsters. In conjunction with the Fraud Division’s dedicated team of data analysts, the prosecutors in the Health Care Fraud Section work to identify, investigate, and prosecute cases using data analytics. This novel approach has led to some of the Section’s largest cases and initiatives.
The Health Care Fraud Section employs a recognized and successful Strike Force Model for effectively and efficiently prosecuting health care fraud and illegal prescription cases across the United States. The Strike Force Model centers on a cross-agency collaborative approach, bringing together the investigative and analytical resources of the Fraud Division, Federal Bureau of Investigation, U.S. Department of Health and Human Services-Office of the Inspector General, Centers for Medicare & Medicaid Services, Drug Enforcement Administration, Defense Criminal Investigative Service, Federal Deposit Insurance Corporation-Office of the Inspector General, Internal Revenue Service-Criminal Investigations, Department of Labor-Office of the Inspector General, United States Postal Service-Office of the Inspector General, Veterans Administration-Office of the Inspector General, and other agencies.
Public Trust & Financial Integrity Section
The Fraud Division’s Public Trust & Financial Integrity Section is focused on dismantling the most complex schemes to defraud the United States and taxpayers, including foreign and domestic companies, organizations, and individuals who defraud public benefit programs, bilk government procurement, or otherwise threaten the financial integrity of the United States or its citizens. The attorneys assigned to the Public Trust & Financial Integrity Section are responsible for developing and advancing investigations of these offenses and prosecuting offenders in district court on behalf of the United States.
Tax Section
The Fraud Division’s Tax Section is focused on enforcing the nation’s criminal tax laws. This effort aims to protect taxpayers from fraudulent tax preparers, identity theft-related tax crimes, and other sophisticated fraudsters targeting Americans and the United States economy. In addition, the Tax Section investigates and prosecutes individuals and corporations that attempt to evade taxes, willfully fail to file returns, submit false tax forms, and otherwise attempt to defraud the internal revenue system. The Tax Section also supervises all criminal tax enforcement conducted across the Department. The attorneys assigned to the Tax Section are responsible for developing and advancing investigations of these offenses and prosecuting offenders in district court on behalf of the United States.
Global Trade & Commerce Enforcement Section
The Fraud Division’s Global Trade & Commerce Enforcement Section investigates and prosecutes criminal import, trade, and other fraud offenses that undermine American industries, evade external revenue collection, threaten consumers’ health and safety, finance foreign adversaries, promote forced labor through illegal trade practices, and violate United States laws governing domestic and foreign commerce. The attorneys assigned to the Global Trade & Commerce Enforcement Section target criminal conduct across the entire supply chain, including bad actors operating as importers, trade brokers, manufacturers, down-chain distributors, warehousers, and resellers. They are responsible for developing and advancing investigations of these offenses and prosecuting offenders in district court on behalf of the United States, providing expert attorney-advisor guidance and strategic support to internal and external partners and leading the cross-agency Trade Fraud Task Force.
Appellate Section
The Fraud Division’s Appellate Section represents the United States in the federal courts of appeals on all Fraud Division matters. The experienced Appellate Counsel assigned to the Appellate Section participate in every aspect of the appellate litigation process, including preparing briefs and arguing cases in federal courts of appeals. In addition, attorneys in the Appellate Section prepare recommendations to the Solicitor General regarding whether to seek further review of decisions adverse to the government and work closely with the Office of the Solicitor General to draft certiorari petitions, briefs in opposition, merits briefs, and other papers for filing in the Supreme Court. Finally, the Appellate Section supports the Fraud Division’s broader enforcement portfolio by providing expert advice to trial attorneys and management regarding complex legal issues.The Fraud Division’s Appellate Section represents the United States in the federal courts of appeals on all Fraud Division matters. Asset Recovery Section
The Fraud Division’s Asset Recovery Section takes the profit out of fraud by using all available civil and criminal authorities to affirmatively seize and forfeit domestic and international assets, by joining criminal investigations and proceedings, and by collecting outstanding judgments on behalf of the United States. The attorneys in the Asset Recovery Section are responsible for working with prosecution teams, analysts, and investigators to find and seize assets that rightfully belong to the American people, for litigating civil and criminal asset recovery matters on behalf of the United States, and for providing subject matter expertise to other attorneys in the Division concerning forfeiture and asset recovery.
Corporate Enforcement Section
The Fraud Division’s Corporate Enforcement Section holds companies accountable while administering the DOJ’s and Division’s policies that reward corporate transparency and cooperation in Division corporate cases. The Section works to ensure that companies are fairly held accountable, with a clear, predictable path to resolution when they choose to voluntarily self-disclose, cooperate, and remediate misconduct. In partnership with Fraud Division litigating units and U.S. Attorney’s Offices nationwide, the Section structures corporate resolutions, evaluates compliance programs, and oversees post resolution matters, incentivizing corporate compliance by promoting proactive cooperation over reactive enforcement.
Special Matters Section
The Fraud Division’s Special Matters Section safeguards the integrity of the attorney-client privilege and the legal profession. The Section fulfills this mission by administering relevant DOJ and Division policies, advising prosecutors on their professional responsibilities, litigating complex privilege disputes, and overseeing a robust privilege filter program to ensure the integrity of federal criminal investigations led by other litigating sections of the Fraud Division, including District Fraud Counsel and their U.S. Attorney’s Offices.
Executive Office
The Executive Office furthers the Fraud Division's mission by providing operational support in the areas of Finance, Procurement, Human Resources, Budget Planning & Analysis, Records, Correspondence, Building Maintenance and Security to the Division's employees in Washington, DC and field locations throughout the United States.
Information Technology Section
The Information Technology (IT) Section enables Fraud Division mission execution through the delivery of IT solutions to over 500 employees and contractors across 94 federal districts. The Section supports the full range of IT including Application Services, Communications, End-User Support, Security, and Program Management. The Section also coordinates delivery of Enterprise IT services from the Department’s Office of the Chief Information Officer including Device Management, Credentialling, Email and Collaboration, Identity and Access Management, and Network Services.
Strategic Communications Section
The Strategic Communications Section is responsible for developing the Division’s legislative agenda, legal memoranda, and Congressional engagement. The Section reviews and prepares comments on pending legislation and other congressional matters affecting the fraud fighting efforts. The Section also coordinates with the Office of Public Affairs to develop and execute a strategic messaging plan for the Division, including researching, drafting, and providing oral advice regarding speeches, talking points, press releases, social media posts, and other public communications.
General Counsel
The Office of General Counsel is the principal legal advisor responsible for providing expert advice and guidance to the Assistant Attorney General and other senior leaders for the Division related to assessing and mitigating significant legal, regulatory, strategic, management, compliance, and other risks across the Division.
Strategic Analysis Section
The Fraud Division’s Strategic Analysis Section provides expert analysis—integrating disparate data, detecting anomalies and networks, prioritizing leads, quantifying harm, and generating data-driven insights—to accelerate investigations, strengthen charging decisions, support litigators from intake through trial, and inform the Fraud Division’s fraud fighting strategy. The scientists assigned to the Strategic Analysis Section comprise subject matter experts from across disciplines, including economics, data science, computer science, artificial intelligence, accounting, and math.
Litigation Support Section
The Litigation Support Section provides boutique, case-customized support to Division attorneys in the preparation for and conduct of discovery, document processing, litigation and trials. The section consists of a dedicated team of Federal employees and contractors responsible for improving operating efficiency and modernizing legal support throughout discovery and trial. The Section leverages technology solutions to help legal teams succeed, including advanced document review software, eDiscovery advising, powerful investigative analytics and search tools, courtroom presentation options, and more. The Section’s staff is experienced with and offer supports for all stages of the eDiscovery lifecycle, particularly processing, review, analysis, and production.
