  1/ The amount is subject to negotiation between the Attorney General and Secretary for Health and Human Services. 
     
  2/ Number includes total appropriation, including $4 million transfer from DHS Immigration Examinations Fee.
     
  3/ The National Security Division was established by Section 506(b)(1), P.L. 109-177, and received appropriations in FY 2007 - 2010.  However, there have not been any authorizations of appropriations for the National Security Division.
     
  4/ In FY09, FY10, and FY 11 CR Congress appropriated $550,000,000, $791,608,000, and $791,608,000 respectively, under the heading "Community Oriented Policing Services."  Funds under such heading were transferred under the requirements of the appropriations acts, to the Office of Justice Programs for the administration of these specific programs.  An OJP component is the properly authorized administering agency of each of these programs, as referenced by this footnote.  OJP administers each of these programs upon the authority granted to it by an underlying authorizing statute and/or delegation of the Attorney General.  In FY 12 these program are requested directly under OJP.
     
  5/ The FBI S&E for FY 2010 includes $101,066,000 for Overseas Contingency Operations.
     
  6/ In FY 09, FY 10 and FY 11 CR this program was appropriated under COPS and in FY 2012 is requested under OJP.
     
  7/ In FY 09 this program was appropriated to OVW, however, the program was administered by OJP. In FY 10 and FY 11 CR this program was appropriated to OJP and in FY 12 is requested under OVW.
     
  8/ RISS was appropriated under OJP Justice Assistance in FY 09, FY 10 and FY 11 CR and is requested under OJP State and Local account in FY 2012.
     
  9/  Bulletproof Vest program in FY 09, FY 10 and FY 11 CR was appropriated under COPS but administered by OJP.  In FY 2012 it is requested within OJP JAG program.
     
  10/ OJP is aware of no statutes that specifically authorize appropriations for these new programs proposed for inclusion in the FY 2012 President's budget. If appropriations are enacted for these programs, the appropriations will operate as both authorization and appropriation.  
     
  11/ All references to the Department of Justice Appropriations Act, 2010 (P.L. 111-117) apply for FY 2010 only.  Subsequent Acts appropriating funds for the Department of Justice may provide continued or additional authorizations.
