Protections Against Discrimination

 FEDERAL PROTECTIONS AGAINST DISCRIMINATION BASED ON RACE, COLOR, NATIONAL ORIGIN, AND RELIGION 

 

The U.S. Attorney’s Office and Department of Justice (DOJ)’s Civil Rights Division enforce several federal statutes that protect against discrimination based on race, color, national origin, and religion.

DOJ Educational Opportunities Section (EOS)

EOS is responsible for enforcing:

  • Title IV of the Civil Rights Act of 1964, which prohibits discrimination on the basis of race, color, national origin, sex, and religion in public schools and institutions of higher learning;
  • Equal Educational Opportunities Act of 1974 which, among other things, requires states and school districts to provide English Language Learner (ELL) students with appropriate services to overcome language barriers; and the Americans with Disabilities Act.
  • Also plays a significant role in enforcing Title VI of the Civil Rights Act of 1964 (prohibiting discrimination on the basis of race, color, and national origin by recipients of federal funds),
  • Title IX of the Education Amendments of 1972 (prohibiting discrimination on the basis of sex by recipients of federal funds), and
  • Section 504 of the Rehabilitation Act (prohibiting discrimination on the basis of disability by recipients of federal funds).

DOJ Housing and Civil Enforcement Section (HCE)

HCE enforces:

  • Fair Housing Act, which prohibits discrimination in housing,
  • Equal Credit Opportunity Act, which prohibits discrimination in credit,
  • Title II of the Civil Rights Act of 1964, which prohibits discrimination in certain places of public accommodation, such as hotels, restaurants, nightclubs and theaters.

 

DOJ Federal Compliance Section (FCS)

FCS coordinates the enforcement by Federal agencies of: Title VI of the Civil Rights Act of 1964, which prohibits discrimination on the basis of race, color, or national origin in federally assisted programs.  Thirty federal agencies that administer federally assisted programs are subject to Title VI, Title IX, and similarly worded provisions of other program statutes that prohibit discrimination on the basis of race, color, national origin, sex, or religion.
