  • Litigation Considerations:"The Court finds no clear error with [the Magistrate Judge's] determination that the Court should dismiss this action."  The Magistrate Judge found that "the Department's response fully released all the documents it possessed, and did not withhold any information or documents from [plaintiff]."  Therefore, the Magistrate Judge found that "the United States retains sovereign immunity against [plaintiff's] claim for money damages under FOIA, and the claim is subject to dismissal for lack of jurisdiction."
