Broemer v. FBI, No. 11-56043, 2013 WL 6405817 (9th Cir. December 9, 2013) (Canby, J., Trott, J., Thomas, J.)

Re: Request for records concerning plaintiff Disposition: Affirming district court's grant of defendant's motion for summary judgment
  • Exemption 3:  The court finds that "[t]he district court properly granted summary judgment" to NSA on plaintiff's FOIA claim "because the agency provided an affidavit establishing that Exemption 3 of FOIA . . . precludes acknowledgment of the existence of the requested documents."  NSA has invoked Exemption 3 pursuant to the National Security Agency Act of 1959 ("NSA Act").
