  • Exemption 3:  The court finds that "[t]he district court properly granted summary judgment" to NSA on plaintiff's FOIA claim "because the agency provided an affidavit establishing that Exemption 3 of FOIA . . . precludes acknowledgment of the existence of the requested documents."  NSA has invoked Exemption 3 pursuant to the National Security Agency Act of 1959 ("NSA Act").
