- Litigation Considerations, Pleadings & Jurisdiction: The court relates that “[t]he plaintiff’s complaint also alleges that multiple Freedom of Information Act (“FOIA”) requests have been improperly denied.” The court finds that, “[t]he plaintiff, however, does not allege that these requests were made to federal agencies.” “Even if his FOIA requests were to federal, not state or local, agencies, any claim under FOIA must be filed in federal district court, not the Court of Federal Claims.”
