  • Litigation Considerations, Exhaustion of Administrative Remedies:  The Court of Appeals for the District of Columbia Circuit holds that "the district court properly dismissed [the requester's] claim under the Freedom of Information Act . . . for failure to state a claim upon which relief could be granted."  The district court previously held that "[b]ecause [plaintiff] cannot seek judicial redress . . . before exhausting his administrative remedies, the claim must be dismissed."
