Evans v. Fed. Energy Regulatory Comm'n, No. 19-00766, 2020 WL 2764608 (D. Or. May 27, 2020) (Aiken, J.)

Re:  Request for list of landowners potentially subject to eminent domain

Disposition:  Adopting magistrate judge's report and recommendation; granting plaintiffs' motion for summary judgment; denying defendant's motion for summary judgment

  • Exemption 6:  "Having considered the record and the arguments offered by the parties, the Court finds no error in [the magistrate judge's] analysis."  "Therefore, the Court adopts the [Findings and Recommendation] in its entirety."  The magistrate judge previously found that "the landowners have more than a de minimis privacy interest in avoiding disclosure of their names and addresses."  Also, "[t]he [magistrate judge] [found] there is a substantial public interest in discovering whether the process used by the government to determine which citizens are sent notice of their due process rights is effective."  "Therefore, the [magistrate judge] [found] that this substantial public interest outweighs the privacy interest in this case."
