Disposition:  Denying plaintiff's motion for reconsideration; granting defendant's cross-motion for clarification

  • Exemption 3:  The court rejects the plaintiff's argument that the defendant has an "alleged inconsistent position . . . [that] bears on the public interest in the whistleblower investigatory records at issue in this case[,]" instead explaining that "Exemption 3 requires no public-private balancing[.]"
