  • Procedural Requirements, Entities Subject to the FOIA:  The court holds that "[c]ourts of the United States . . . are statutorily excluded from the definition of 'agency' and exempt from the disclosure requirement of FOIA."  "This exemption extends to United States probation offices because they are an arm of the federal courts."  "[Plaintiff's] claim, therefore, faces the insurmountable substantive barrier that the United States probation office is not subject to FOIA's disclosure requirements, nor are its officers . . . ."  "[Plaintiff] acknowledges that the polygraph documents are property of the Court."
