  • Litigation Considerations, Exhaustion of Administrative Remedies:  The court holds that "SSA responded to plaintiff's FOIA request . . . more than 20 working days after its receipt of the . . . request."  However, "[p]laintiff filed his lawsuit [after defendant's response], yet in the interim, he did not file an administrative appeal of SSA's determination."  The court finds that "SSA has demonstrated that plaintiff failed to exhaust his administrative remedies, and, therefore, the court grants its motion for summary judgment."
