Jordan v. DOL, No. 18-06129, 2019 WL 1549722 (W.D. Mo. Apr. 9, 2019) (Smith, S. J.)

Re:  Requests for certain letters sent from Office of Administrative Law Judges, as well as certain emails sent employees of outside company

Disposition:  Granting defendant's motion for summary judgment

  • Procedural Requirements:  The court finds that "DOL has established it fully discharged its obligations under the FOIA in that Plaintiff was given access to the very documents he sought in one of the formats he sought."  "Accordingly, the DOL's motion for summary judgment is granted in its favor."  The court explains that "Plaintiff fails to set forth legal authority demonstrating the DOL violated the FOIA when it made the ALJ's decision publicly available in PDF format, or the DOL, in response to his FOIA request, violated the FOIA when it provided the website where the ALJ's decision was located but did not reproduce the record."
