• Litigation Considerations, Jurisdiction:  The Court of Appeals for Veterans' Claims holds that "Congress has expressly provided that compliance with Privacy Act and FOIA requests will be enforced through U.S. district courts."  "Thus, even if district courts ultimately prove to be the only legally viable option for compelling the release of VA records, any policy decision as to whether that forum is appropriate to handle these matters is a question for Congress, not for [the] Court sitting en banc or otherwise."
