  • Procedural Requirement, Entities Subject to the FOIA:  The court finds that it "has no authority to grant Plaintiff the relief he seeks" because "Plaintiff does not allege that any federal agency improperly withheld the evidence he seeks "  The court notes that plaintiff is seeking information maintained by city or state agencies and that the FOIA "does not apply to municipal or state agencies."  "[I]t is beyond question that FOIA applies only to federal and not state agencies."
