• Litigation Considerations, Pleadings:  The court finds that “[a]s the USDA points out, Plaintiff’s Amended Complaint includes no allegations that he made a FOIA request in the first place, nor does he offer any factual allegations or legal argument upon which the Court may conclude the USDA improperly withheld agency records.”  “Accordingly, Plaintiff’s FOIA claim must be dismissed.”
